Press Release – FTC To Vote on Advanced Notice of Proposed Rulemaking Concerning Earnings Claims

The Federal Trade Commission (FTC) has announced a tentative agenda for its Open Commission Meeting on February 17 and one of the main topics is of particular interest to the direct selling industry.

Among other items, the commission is planning to discuss and vote on the Advanced Notice of Proposed Rulemaking Concerning Earnings Claims. According to the press release issued:

Agenda - Earnings Claims

“The following items will be on the tentative agenda for the February 17 Commission meeting:

Advanced Notice of Proposed Rulemaking Concerning Earnings Claims: Staff will provide a presentation and the Commission will vote on an Advance Notice of Proposed Rulemaking to address deceptive earnings claims for business ventures, gig or other work opportunities, or educational, coaching or training offerings.

At the start of the meeting, Chair Khan will offer brief remarks and will then invite members of the public to share feedback on the Commission’s work generally and bring relevant matters to the Commission’s attention. Members of the public must sign up for an opportunity to address the Commission virtually at the February 17 event. Each commenter will be given two minutes to share their comments. Anyone who cannot participate during the event may submit written comments or a link to a prerecorded video through a webform. Speaker registration and comment submission will be available through Tuesday, February 15, 2022, 8pm ET.”
